The Consumer has the right to withdraw from the online purchase within 14 days from the moment when the goods are delivered to the customer, or a third party designated by the Consumer, who is not the carrier, without giving reasons and additional costs (hereinafter: withdrawal from the contract). If the buyer notices that the product itself is damaged, it is necessary to report to the e-mail office@madhouse.rs or to the phone number 011/342-53-66 within 24 hours from the moment of receipt of the package.
In the event that there is no application by the buyer within the specified period, the seller is not responsible for the delivered goods. And the buyer reserves the right to complaint in accordance with the rights of the consumer and all applicable legal regulations.
The consumer is entitled to withdraw from the contract by a statement that he can make on a special form for withdrawal from the contract concluded at a distance, which he receives in a package with delivered items, i.e. outside the business premises or in another unambiguous way (hereinafter: withdrawal form).
A statement of withdrawal from the contract for a distance contract is considered timely if it is sent to the Seller by post, to the company’s headquarters, within the period referred to in paragraph 1.
A statement of withdrawal from the contract shall have legal effect from the date it was sent to the Seller.
The consumer shall bear the burden of proving that he has acted in accordance with the provisions of this Article, in order to exercise the right of withdrawal from the contract.
Upon expiration of 14 days from the moment when the goods are delivered to the Consumer, or a third party designated by the Consumer, who is not the carrier, the consumer’s right to withdraw from the contract ceases.
The consumer bears only the direct costs of returning the goods, except in the case where the reason for the return is an error of the Seller. The consumer is solely responsible for the reduced value of the goods, which arises as a result of handling the goods in a way that is not adequate, i.e. exceeds what is necessary, in order to establish the nature, characteristics and functionality of the goods.
In the case of using the right to withdraw from the contract, the Seller is obliged to refund payments received from the Consumer without delay, and no later than 14 days from the day when he received the withdrawal form from the contract.
The Seller makes a refund using the same means of payment that the Consumer used in the original transaction. The seller may postpone the refund until he has received the goods returned or until the Consumer has provided proof of sending the goods to the Seller.
What is not considered a withdrawal from the contract within the meaning of Art. 28 of the Consumer Protection Act:
If the Consumer, after ordering a certain item through the MAD House online store and the order has been confirmed by MAD House online store, does not pick up the shipment, after two attempts to deliver it by the courier service with which MAD House d.o.o. Beograd has concluded a Contract on the provision of delivery services, it is considered that the Consumer has not withdrawn from the contract within the meaning of Art. 28 of the Consumer Protection Act.
In accordance with the Torts Act, if the buyer never takes over the ordered items, the contract of sale is terminated due to violation of the contractual obligation to take over the item, and the seller is entitled to compensation for the damage he suffers as a result, according to the general rules on compensation for damages.
The obligation to compensate for damages is considered due from the moment of occurrence of damage. Therefore, in case of non-pick-up of the shipment, the Consumer is obliged to compensate the Seller for the damage caused.
The consumer is not entitled to withdraw from the contract in the case of delivery of packaged goods that cannot be returned due to health protection or hygiene reasons and /or which are unpacked after delivery. The consumer is not entitled to withdraw from the contract if the purchased items is underwear, swimsuits, socks and similar products.
