These terms of use regulate the general terms of business, that is, your access and use of the website https://madhouse.rs/ (hereinafter referred to as the “site”) is subject to the following terms of use as well as all applicable laws. If you do not agree with them or do not fully accept them, please leave the site.

Contractual relationship*

By registering to use the site, i.e. filling out the form, for the purpose of buying and selling, as well as accessing the site for informational purposes (where applicable), you agree to these Terms of Use and thus conclude an access contract with the information society service provider.

The price and description of the product, as well as other elements of the sales contract, are given in the continuation of these terms of use as well as on the site itself.

The method of concluding a distance sales contract is given below.

The online store, i.e. the site as well as its entire content are the property of the company MAD House d.o.o. Belgrade (hereinafter referred to as the “Company”), whereby all rights are reserved, unless otherwise indicated. The site is intended for the presentation and sale of products to users. A user is a person, that is, a customer on the site. When you visit the site and every time you make a purchase, it is assumed that you are familiar with and accept the terms of use, which we will present to you in more detail below. Please read them carefully.

Your use of content that does not comply with the terms of use without the written consent of the owner of the content is strictly prohibited.

The use of the website https://madhouse.rs/ allows the use of the site in the following way:

In certain parts of the site, users are invited to submit their personal data (“submitted content”) when ordering products through it.
The site may contain various actions in which MAD House d.o.o. invites users to submit their personal data (“submitted content”) when ordering products through it. Any submitted content must comply with the current rules of the promotion.
When using the site, behave in accordance with applicable laws and regulations. The content of the site may not be distributed, modified, displayed-reproduced, sold, copied or in any other way used and made available to third parties without the written consent of the company MAD House d.o.o.
It is forbidden to send/deliver material that is defamatory, violates rights, is offensive, false, threatening, vulgar, pornographic, simple, or in any way incites to a criminal offense, illegal activity or that calls for civil liability. We will not provide the data you have entrusted to us to unauthorized third parties and we will treat them in accordance with the applicable Law on Personal Data Protection (“Official Gazette of RS” No. 87/2018). Access to the collected data is granted exclusively to authorized employees of MAD House d.o.o. Beograd. All employees of MAD House d.o.o. Beograd are aware of the importance of maintaining confidentiality and are responsible for respecting this Privacy Policy.

This Privacy Policy contains information on the type of personal data being processed, the legal basis and purpose of the processing of personal data, the rights of data subjects, the controller, processors and recipients of personal data, the time period of retention of personal data and amendments to this Privacy Policy.

MAD House d.o.o. Belgrade processes the personal data set out in this Privacy Policy on a registered user with the purpose of:

  • Responding to a user’s request or request and providing the best possible service;
  • Processing the order (e.g. informing the customer about the status of the order, delivery time, responding to any requests related to the order, etc.)
  • Enabling customers to submit complaints and returns in the online store;

Also, you agree that neither MAD House d.o.o. nor its affiliates, shall be liable to You or any third party for any termination of Your access to this Site, or any information or files, nor shall they be required to make such information or files available to You following any such termination.

Product description*

The products on the site are original and the brands presented on the site. All products are purchased directly from the manufacturer.

MAD House d.o.o. strives to describe all products on the website as accurately as possible. Products are presented by category. Products are presented in text and shown in photos. The photo of the product that represents the group can serve as basic information about the appearance of the product. Please note that the product photo is provided for informational purposes only and we cannot guarantee that it unconditionally faithfully depicts the appearance of the product.

Payment methods

In MAD House it is possible to pay with cash and cards of all types and all banks.
There is a possibility to pay in 3 installments for holders of Banca Intesa cards and private citizens’ cheques.

Statement of Conversion*

All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). For informative display of prices in other currencies, the middle exchange rate of the National Bank of Serbia is used. The amount for which your payment card will be charged will be expressed in your local currency through conversion to the same at the exchange rate used by card organizations, which cannot be known to us at the time of the transaction. As a result of this conversion there is a possibility of a slight difference from the original price listed on our website.

VAT statement*

MAD House d.o.o. is in the VAT system and all prices on the site are expressed with VAT included. The exact amount of VAT is clearly stated at the Cashier’s Office, before confirming the order, and it is also stated on the purchase order sent to your email address.

Product prices*

All prices displayed on our website are expressed in the currency of the Republic of Serbia (RSD) and in the currency of the European Union (EUR). We undertake to deliver the product to you at the price you were informed about when confirming your order, and any possible price changes of the specific products you ordered will not affect the value of your purchase.

Depending on the final value of your order, shipping costs may be included in the displayed price or charged additionally. For more information on shipping costs, please see the Shipping Costs section.

MAD House d.o.o. reserves the right to change the prices of individual items from the offer on a daily basis, in order to ensure convenience for the Buyer during the duration of the promotional period, about which the Buyer will be clearly and promptly informed.

Delivery

Delivery times

After receiving the order from the Consumer, the Online sales team of MAD House performs a check on the availability and quality of ordered items. If the ordered items are available, a confirmation of receipt of the order is sent to the Consumer and the delivery deadlines begin to run.

If the ordered item is not in stock and a certain deadline for production is required, the Consumer receives an e-mail or a call with information about the current unavailability of the item and confirms whether he agrees with the waiting deadline.

The seller undertakes to deliver the purchased goods to the Consumer by sending the goods through the courier service, with which he has concluded a Contract on the provision of express services in internal traffic.

The delivery time is normally up to 3 working days from the first following working day from the date of dispatch.

The consumer will be notified of the delivery time by phone by courier service.

After the courier service picks up the package from MAD House, the Consumer will be forwarded an automatic message to the e-mail or phone with the code of the shipment that he can track.

Please note that there may be possible delays in delivery during holiday seasons or during the sales period, as delivery depends on external services.

For all orders through MAD House online sales channels, the Consumer, by accepting these Terms of Use, undertakes to pay the delivery costs in the name of delivery costs.

Costs of transport

The product arrives to you by courier service. MAD House d.o.o. undertakes to deliver the order to the courier service within one to two working days after the creation of the item, MAD House d.o.o. is not responsible for delivery times after delivery to the courier service. If you have chosen to pay for the goods by cash on delivery, upon collection you pay the purchase price + postage, which for Serbia is 350 dinars. If you pay by credit card, you pay the postage on the website and do not pay anything to the courier upon delivery. The courier will contact you via mobile phone shortly before delivery.

Product packaging

We will pack the products you order through the site in a way that protects the integrity of the shipment (transport packaging).

Download method

You can pick up the goods you ordered through the site in the following ways:

  • At the registered address, the goods are delivered by courier service to the address you provided as your address when registering on the site;
  • On a different address, if you want the ordered goods to be delivered to a different address than the one you specified as your address during registration, you can indicate this when creating the order.

IMPORTANT NOTE: We recommend that you determine the condition of the shipment before picking it up.
It is very important that you note all transport damage visible on the transport packaging before taking over the shipment. If you notice damage to the transport packaging, ask the courier to wait for you to open the package and check whether the damage to the package caused damage to the delivered products. If you notice irregularities on the product itself, return the delivered product by courier.

If you fail to determine the damage before collection, we recommend that you contact the courier service that delivered the package within 24 hours of delivery in order to compile a record of the damage. By following this procedure, your rights will be protected in the most effective way.

Complaints

Consumers may declare any outstanding complaints and remarks in the following manner:

  • By sending e-mail to an e-mail address: office@madhouse.rs;
  • On the store phone number 011/342-53-66 in the period from 10 am to 8 pm every day
  • Regular post sent to the address: MAD House d.o.o. Beograd, Južni bulevar 142, 11000 Belgrade

MAD House will confirm that the complaint has been received. Within 8 days from the date of receipt of the complaint, the seller will notify the consumer in writing or electronically of the decision (accepted or rejected consumer complaint regarding the conformity of the item), as well as about the possible way of resolving the complaint in accordance with the Consumer Protection Act (refund, appropriate price reduction or repair of the item). The complaint will be resolved within 15 days from the date of receipt of the complaint. The seller will do everything in his power to resolve the disputed situation, all with the aim of eliminating the defects in question.

The consumer can exercise his rights on the basis of conformity within 2 years. The deadline for resolving the complaint is interrupted when the consumer receives the seller’s response and begins to run anew when the seller receives the consumer’s statement on the seller’s response. The consumer is obliged to declare the seller’s reply no later than three days from the date of receipt of the seller’s response. The consumer will be deemed not to agree with the seller’s proposal unless he declares himself within three days. In the event that the seller refuses the complaint:

He is obliged to provide appropriate information to the consumer in case of rejection of the complaint (the seller’s explanation in case of non-acceptance of the complaint).
He is obliged to inform the consumer comprehensively about the possibility of resolving the dispute by out-of-court, as well as about the competent bodies for out-of-court settlement of consumer disputes.

OBAVEŠTENJE O PRAVU NA REŠAVANJE POTROŠAČKOG SPORA VANSUDSKIM PUTEM

Obaveštavaju se potrošači o pravu na rešavanje potrošačkog spora vansudskim putem koji se pokreće podnošenjem predloga za pokretanje vansudskog rešavanja potrošačkog spora telu sa liste koju Ministarstvo nadležno za poslove zaštite potrošača sačinjava i javno objavljuje.

Postupak pred telom može da pokrene potrošač samo ukoliko je prethodno izjavio reklamaciju ili prigovor trgovcu, a predlog može da se podnese tek nakon prijema odgovora na izjavljenu reklamaciju.

Trgovac je po zakonu obavezan da učestvuje u postupku vansudskog rešavanja potrošačkih sporova, koje po zakonu može da traje najduže 90 dana od dana podnošenja predloga. Izuzetno u opravdanim slučajevima kada je predmet spora složen, rok od 90 dana se može produžiti za najviše još 90 dana, o čemu telo zaduženo za rešavanje vansudskih potrošačkih sporova bez odlaganja obaveštava potrošača i trgovca.

Potrošač može odustati od daljeg učešća u vansudskom rešavanju potrošačkog spora do okončanja postupka.

Refunds

In the case of returning goods and refunding funds to a customer who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, MAD House d.o.o. is obliged to make the refund exclusively via VISA, EC/MC, Maestro, Dina and Amex payment methods, which means that the bank will refund the funds to the card user’s account at the seller’s request.

Right of withdrawal

The Consumer has the right to withdraw from the online purchase within 14 days from the moment when the goods are delivered to the customer, or a third party designated by the Consumer, who is not the carrier, without giving reasons and additional costs (hereinafter: withdrawal from the contract). If the buyer notices that the product itself is damaged, it is necessary to report to the e-mail office@madhouse.rs or to the phone number 011/342-53-66 within 24 hours from the moment of receipt of the package.

In the event that there is no application by the buyer within the specified period, the seller is not responsible for the delivered goods. And the buyer reserves the right to complaint in accordance with the rights of the consumer and all applicable legal regulations.

The consumer is entitled to withdraw from the contract by a statement that he can make on a special form for withdrawal from the contract concluded at a distance, which he receives in a package with delivered items, i.e. outside the business premises or in another unambiguous way (hereinafter: withdrawal form).

A statement of withdrawal from the contract for a distance contract is considered timely if it is sent to the Seller by post, to the company’s headquarters, within the period referred to in paragraph 1.

A statement of withdrawal from the contract shall have legal effect from the date it was sent to the Seller.
The consumer shall bear the burden of proving that he has acted in accordance with the provisions of this Article, in order to exercise the right of withdrawal from the contract.

Upon expiration of 14 days from the moment when the goods are delivered to the Consumer, or a third party designated by the Consumer, who is not the carrier, the consumer’s right to withdraw from the contract ceases.

The consumer bears only the direct costs of returning the goods, except in the case where the reason for the return is an error of the Seller. The consumer is solely responsible for the reduced value of the goods, which arises as a result of handling the goods in a way that is not adequate, i.e. exceeds what is necessary, in order to establish the nature, characteristics and functionality of the goods.

In the case of using the right to withdraw from the contract, the Seller is obliged to refund payments received from the Consumer without delay, and no later than 14 days from the day when he received the withdrawal form from the contract.

The Seller makes a refund using the same means of payment that the Consumer used in the original transaction. The seller may postpone the refund until he has received the goods returned or until the Consumer has provided proof of sending the goods to the Seller.

What is not considered a withdrawal from the contract within the meaning of Art. 28 of the Consumer Protection Act:

If the Consumer, after ordering a certain item through the MAD House online store and the order has been confirmed by MAD House online store, does not pick up the shipment, after two attempts to deliver it by the courier service with which MAD House d.o.o. Beograd has concluded a Contract on the provision of delivery services, it is considered that the Consumer has not withdrawn from the contract within the meaning of Art. 28 of the Consumer Protection Act.

In accordance with the Torts Act, if the buyer never takes over the ordered items, the contract of sale is terminated due to violation of the contractual obligation to take over the item, and the seller is entitled to compensation for the damage he suffers as a result, according to the general rules on compensation for damages.

The obligation to compensate for damages is considered due from the moment of occurrence of damage. Therefore, in case of non-pick-up of the shipment, the Consumer is obliged to compensate the Seller for the damage caused.

The consumer is not entitled to withdraw from the contract in the case of delivery of packaged goods that cannot be returned due to health protection or hygiene reasons and /or which are unpacked after delivery. The consumer is not entitled to withdraw from the contract if the purchased items is underwear, swimsuits, socks and similar products.

Refund or exchange

Please note that all pieces by local designers are slow fashion, made in small series and made to order, sometimes also made to measure. In this regard, unfortunately, we are not able to return the item, unless the complaint relates to the conformity of the item with the description of the product.

The consumer is not entitled to a refund of worn items, unpacked items and items which cannot be returned due to health protection or hygiene reasons. In this sense, the consumer does not have the right to withdraw from the purchase if the item falls within categories: underwear, swimsuits, socks and similar products.

Law and competences

The terms of use and the use of this site are subject to the laws of the Republic of Serbia, and in case of dispute, the competent courts in Belgrade apply the laws of the Republic of Serbia. If you are a resident of another country, the Terms of Use and your use of the Site are subject to the laws of your country.

Rules for loyalty programs, surveys, promotions and similar promotions

All promotions, contests, loyalty programs and similar promotions made available through this site will be subject to certain rules that are separate from these Terms of Use. By participating in them, you will be subject to those rules, which may differ from the terms and conditions set forth herein.
